DMCA Guidelines

Welcome to the DMCA Guidelines page of the Promissory Note for Car website. Our commitment to protecting and respecting copyrights ensures that all content on our website supports creators and copyright holders. Here, we detail the processes and practices established under the Digital Millennium Copyright Act (DMCA) that uphold these principles. Whether you are a copyright owner or someone concerned about content usage, this guide aims to clarify the steps you can take to address copyright concerns on our platform.

Understanding the DMCA

The Digital Millennium Copyright Act (DMCA) is a landmark legislation enacted in the United States to address the needs of copyright holders in the digital age. It provides a legal framework for copyright owners to request the removal of copyrighted content used without permission on online platforms. The DMCA safeguards both the creators' rights and the platforms' operations, ensuring a balanced and fair digital environment for all parties involved.

How to Submit a DMCA Notice

If you believe that your copyrighted material has been posted on our website without your permission, we encourage you to inform us. By submitting a DMCA notice, you initiate a formal procedure for the removal of the infringing material. To ensure a swift and accurate response, your DMCA notice must include the following:

  • A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  • Identification of the copyrighted work claimed to have been infringed.
  • Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed, with sufficient detail to allow us to locate the material on our site.
  • Your contact information, including your address, telephone number, and, if available, an email address.
  • A statement by you that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  • A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Notices should be sent to our dedicated DMCA Agent via email at dmca@promissorynoteforcar.com. On receipt of a valid claim, we will act expeditiously to remove or disable access to the infringing material and notify the party that posted it on our site.

Counter-Notice for Restoring Content

If content you have posted on our website has been removed due to a DMCA notice and you believe this was done in error, you may submit a counter-notice. Like the DMCA notice, this document must be well-documented and contain the following:

  • Your physical or electronic signature.
  • Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or disabled.
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or a misidentification of the material to be removed or disabled.
  • Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal court for the district in which your address is located, or if your address is outside of the United States, for any district in which we may be found, and that you will accept service of process from the person who provided notification of the alleged infringement.

Upon receipt of a valid counter-notice, we will promptly forward it to the parties that submitted the initial DMCA notice. If the original complaining party does not seek a court order to prevent further infringement of the content at issue within 14 business days, we may, at our discretion, restore or cease disabling access to the material that was removed.

At the Promissory Note for Car website, we are deeply committed to respecting copyright laws and ensuring that our platform remains compliant and respectful of creators’ rights. By closely following the guidelines outlined above, we can work together to maintain a digital space that honors and protects the work of all creators.
